Applecare Rules and Regulations

Coverage starts when you buy the plan. “Plan Term” means the date on which your Plan begins in accordance with the preceding sentence and, unless cancelled, ends on the date specified in your Plan Confirmation. Your plan confirmation will be provided to you at or around the time of purchase or will be sent to you automatically thereafter. If you purchased your plan from Apple, you can get a copy of your plan confirmation by following the instructions and entering the serial number of your covered device at www.apple.com/support/applecare/view. (A) Australia. The rights described in this Policy with respect to returns, refunds and warranties are in addition to the statutory rights to which you are entitled under the Consumer and Competition Act 2010 and other applicable Australian consumer laws and regulations. 7.7. If you attempt to make a claim under this Policy in a country that is not the country of purchase, you must comply with all applicable import and export laws and regulations, and you will be responsible for all duties, value-added taxes and other related taxes and duties that may apply. Please note that if you are using the service under this plan in a country other than your country of purchase, the service fee must be paid in the currency of that country and at the rate applicable in that country – for details, including applicable fees per country, please visit the AppleCare+ support website at apple.com/legal/sales-support/applecare/applecareplus/. HOW CONSUMER RIGHTS AFFECT THIS PLAN THE BENEFITS GRANTED BY THIS PLAN ARE IN ADDITION TO THE RIGHTS AND REMEDIES GRANTED UNDER CONSUMER PROTECTION LAWS AND REGULATIONS. THIS PLAN IS WITHOUT PREJUDICE TO THE RIGHTS GRANTED BY APPLICABLE CONSUMER LAW, INCLUDING THE RIGHT TO SEEK RELIEF UNDER STATUTORY WARRANTY LAW AND TO SEEK DAMAGES IN THE EVENT OF APPLE`S FAILURE TO PERFORM ANY OF ITS CONTRACTUAL OBLIGATIONS. 1. The plan.

This Service Agreement governs the hardware service and technical support provided to you by Apple as part of the above plans (each, the “Plan”) for an Apple-branded iPhone, iPad, iPod, Apple Watch or Apple Watch Sport and the accessories included in the original packaging (“Covered Device”) listed in your Proof of Coverage document (“Plan Confirmation”). Please note that the benefits of AppleCare+ for Apple Watch and AppleCare+ for Apple Watch Sport for Apple Watch Edition are not available. Apple also provides hardware service and technical support for an AirPort Express or AirPort Extreme base station, as well as an AirPort Time Capsule product (“iPad Connectivity Device”) if the iPad connectivity device is used with an AppleCare+ iPad for iPad iPad that was purchased no earlier than two years prior to the covered iPad. (For the purposes of this Service Agreement, the Covered Device and, if applicable, the iPad Connection Device are collectively referred to as the “Covered Equipment.”) 2. When the declaration begins and ends. Coverage starts when you buy the plan. Coverage ends on the date indicated in your plan confirmation (“Plan Term”). Your plan confirmation will be provided to you at or around the time of purchase or will be sent to you automatically thereafter. The terms of this plan, the original proof of purchase of your plan, and the plan confirmation are each part of your service contract. To get a copy of your plan confirmation, follow the instructions and enter the serial number of your covered device at www.apple.com/support/applecare/view. You can find the price of the plan on the original proof of purchase. Coverage for this plan is in addition to coverage under applicable mandatory laws, the manufacturer`s hardware warranty, and free technical support.

3. What is covered? 3.1 Hardware Service If you make a valid claim during the term of the Plan by notifying Apple that (i) a defect in materials and workmanship has occurred in the Covered Equipment, or (ii) that the battery capacity of the Covered Equipment to accommodate an electrical charge has been exhausted fifty (50%) or more than the original specifications, Apple will (a) repair the defect free of charge, use new parts or parts equivalent to new parts in terms of performance and reliability, or (b) replace the covered product with a replacement product that is new or newly equivalent in terms of performance and reliability. All substitute products supplied under this plan are at least functionally equivalent to the original product. If Apple replaces the Covered Product, the Original Product becomes the property of Apple and the Replacement Product is your property, with coverage for the remainder of the Plan. 3.2 Accidental Damage Caused by Handling If, during the term of the Plan, you make a valid claim informing Apple that the Covered Device has failed due to accidental damage caused by handling (“ADH”), Apple, subject to the service charges described below, (i) will remedy the defect with new or refurbished parts equivalent to new parts equivalent to new parts in terms of performance and reliability, or (ii) replace the Covered Equipment with a replacement Product that is new or equivalent in terms of performance and reliability (both of which are individually referred to as a “Service Event”). DHA Coverage will expire and all of Apple`s obligations to you under this Section 3.2 will be fulfilled in their entirety before the end of the Plan Term if Apple has provided you with two (2) Service Events as a result of ADH claims. ADH coverage only applies to an operational or mechanical failure caused by a handling accident due to an unexpected and unintentional external event (for example, falls and damage caused by liquid contact, except as a result of defects in materials and workmanship) resulting from your normal daily use of the covered product, as provided for this covered equipment. ADH coverage does not include (a) protection against normal wear and tear, theft, misplacement, reckless, abusive, intentional or intentional driving in connection with the handling and use of the covered equipment, (b) protection against other actions or outcomes not covered by the plan as described in section 4.2 below, or (c) damage resulting from the covered equipment resulting from one or more of the products covered in section 3.2 (a) or ( (b) the conditions described.

Apple may ask you to provide an explanation of where and when the accident occurred with a detailed description of the actual event. Apple will deny your claim if you don`t pay the service fee or if you don`t provide information about the accident upon request. – As part of AppleCare+ for iPhone, you pay a service fee of $79 ($79 CAD) plus applicable taxes for each DHA claim. – As part of AppleCare+ for iPad, you pay a service fee of $49 ($49 CAD) plus applicable taxes for each DHA claim.
